Digital Millennium Copyright Act Notice

This website (the “Site”) qualifies as a “Service Provider” under the terms of 17 U.S.C. § 512(k)(1) of the Digital Millennium Copyright Act (“DMCA”). As a Service Provider, the Site is protected by certain "safe harbor" provisions against copyright infringement claims. We respect the intellectual property rights of others and ask our users to do the same. Accordingly, we comply with the DMCA for copyright claims under U.S. law and have adopted the following Notice and Takedown Policy for materials on our Site. In other jurisdictions, we adhere to relevant local copyright laws.

Notice of Claimed Infringement

If you believe your copyrighted work has been used on the Site in a way that constitutes copyright infringement, please provide our Designated Copyright Agent (listed below) with the following information:

  • (a) An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
  • (b) A description of the copyrighted work you claim has been infringed;
  • (c) A description of where the allegedly infringing material is located on the Site (including the specific URL where the material appears);
  • (d) Your address, telephone number, and email address;
  • (e) A statement, made in good faith, that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • (f) A statement, made under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Please note: Only DMCA-related inquiries should be sent to our Designated Agent. Misusing the DMCA Notice procedure or providing false information in a DMCA Notice or Counter-Notification can result in legal liability under 17 U.S.C. § 512(f), including liability for damages, court costs, and attorney fees.

These Notice and Takedown procedures are for copyright infringement claims by copyright holders or their authorized agents only. They do not cover other types of legal claims.

Takedown Procedure

Upon receiving a valid DMCA notice, we will take the following actions:

  1. Remove or disable access to the allegedly infringing material;
  2. Forward the written notification to the user who posted the material ("User"); and
  3. Notify the User promptly that we have removed or disabled access to the material.

If your notice does not fully comply with § 512 of the DMCA but identifies the alleged infringement, we may reach out to help you meet the DMCA notice requirements.

Counter Notification

If you are a User who has received notice that material you posted has been removed following a DMCA complaint, and you believe you are authorized to use this material, you may submit a counter-notification. This counter-notification should include:

  • (a) Your physical or electronic signature;
  • (b) Identification of the material removed or access-disabled and where it was located before it was removed;
  • (c) A statement, under penalty of perjury, that you believe the material was removed or disabled due to mistake or misidentification;
  • (d) Your name, address, telephone number, and email address; and
  • (e) A statement that you consent to the jurisdiction of the Federal District Court for your location, or if outside the United States, any jurisdiction in which we operate, and that you will accept service of process from the complaining party or their agent.

Upon receiving a valid counter-notification, we will:

  1. Send a copy of the counter-notification to the complaining party;
  2. Inform the complaining party that we will restore the removed material or re-enable access within ten (10) business days; and
  3. Restore the material within ten (10) to fourteen (14) business days unless we receive notice that the complaining party has filed a court action to restrain the User from infringing activity on our network.

Important

Under the DMCA, we cannot assess the merits of a claim or counter-claim. Therefore, we will act only according to the procedures detailed here or as required by law.

Repeat Infringers

It is our policy to terminate the accounts of repeat infringers and/or block such users from posting additional content whenever technically feasible.
